$6 Million Class Action Lawsuit Against Conman Rocco Galati
The lawsuit is seeking financial remedy of $6 million, with interest, plus court costs. And a full “accounting and disgorgement of revenue” from each of the six cases.
Finally, some justice is appearing on the horizon for the Canadian Freedom Movement. During a time when people were vulnerable, depressed and under the thumb of tyranny, Canadians were not only subjected to government and medical overreach, but those opposed to lockdowns, mask mandates and toxic injections were assaulted from within, by unscrupulous individuals like Rocco Galati, who extorted millions of dollars from the Freedom Movement.
A class action lawsuit, seeking over $6 million in damages, has been filed in Alberta court, on behalf of four defendants who accuse Galati of malpractice, incompetence and exploiting individuals, by filing doomed-to-fail lawsuits.
The Galati Defendants and the CRC [Constitutional Rights Center] engaged in conduct, which was reckless, self-serving, and indifferent to the foreseeable harm suffered by the plaintiffs and class members. They acted with a blatant disregard for the plaintiffs and class members’ best interests, exploiting individuals who were vulnerable and reasonably reliant upon the defendants’ representations.
The Galati Defendants’ actions have undermined the trust between solicitor and client, risking disrepute and fracturing public confidence in the legal profession.
Galati’s windfall from the Canadian Freedom Movement resulted in his purchase of a $2 million home, that he paid CASH for in 2021:
The lawsuit alleges negligence in six legal challenges that Galati filed between 2020 and 2024, in Ontario, British Columbia, and federal courts, on behalf of various pro-freedom groups, such as Action4Canada, Vaccine Choice, Police On Guard and others.
Action4Canada’s case is likely the most egregious betrayal of client-lawyer trust of all of Galati’s lawsuits. The lawsuit has been dubbed “bad beyond argument” by the legal profession. The massive 391-page filing was dead on arrival when it was filed in BC Supreme Court.

The Class Action Lawsuit alleges:
1. Starting in 2020, the defendants [Galati and the Constitutional Rights Center] encouraged and benefitted from public fundraising efforts resulting in millions of dollars in legal fees collected to commence litigation across Canada, which challenged various government SARS-CoV-2 virus (“COVID-19”) measures, including constitutional challenges.
2. However, the pleadings drafted in each action disregarded basic rules of court, statutes, common law principles, and made claims that the respective courts did not have jurisdiction to entertain, amongst others. The pleadings were so poorly drafted, they never had a chance of being heard on the merits These pleadings have been described as “bad beyond argument” by more than one judge.
3. The Defendants, Rocco Galati and Rocco Galati Law Firm Professional Corporation (together referred to as the "Galati Defendants") charged exorbitant legal fees to draft pleadings that they knew or ought to have known would be struck. Rather than amending the pleadings, the Galati Defendants recommended costly appeal proceedings which they knew or ought to have known would fail and would result in significant legal expense.
6. The manner in which the Galati Defendants represented the plaintiffs in each action was negligent, constituted a breach of contract and was in breach of fiduciary duties. In the result, clients of the Galati Defendants were ordered to pay up to $200,000 in court costs due to the manner in which the Galati Defendants had managed each legal proceeding.

One of the plaintiffs, Scarlett Martyn, who testified at the National Citizen’s Inquiry, was fired from her 23-year career as a paramedic in Ontario, for refusing to take the vaccine.

Citing the adverse reactions some have experienced, Martyn doesn’t feel the one-size-fits-all approach demonstrates medical freedom.
“I am for people having a choice on their medical decisions,” she said. “This is forced, and I have reminded people of the ethical and moral dilemma in that.”
Martyn said since she already had COVID-19, she has antibodies that should warrant an exemption from the decree. She also wrote a four-page letter to try to convince the powers that be to reconsider suspending her and hundreds of other first responders.
“I am no anti-vaxxer,” she said. “As a paramedic, I have had numerous required vaccinations.”
But she does have concerns about COVID vaccines.
“In my position, I have seen patients develop heart inflammation,” said Martyn. “One of the first patients I dealt with, who had taken the vaccine, suffered a cerebral venous thrombotic stroke. This specific type of stroke is now recognized as a new syndrome of vaccine-induced immune thrombotic thrombocytopenia (VITT). This obviously and reasonably makes me concerned that I may also have a serious adverse event.”
Rocco Galati appeared at rallies in Ontario in September 2021, offering himself up as a legal saviour, to save Canada from the sins of the COVID tyrants:
The strength of Galati’s success in convincing so many Canadian freedom people to invest in his bogus lawsuits, was magnified by the personal advocacy of Tanya Gaw (Action4Canada) and Ted Kuntz (Vaccine Choice Canada), neither of whom have stepped forward to repent or apologize for leading Canadians down the garden path.

Along with the financial remedy sought by the plaintiffs, there is also the added mention of “punitive and exemplary damages,” meaning the plaintiffs are asking the judge to fine Galati, and punish him for his gross abuse of the legal profession.
The pandemic of 2020 brought out the best and the worst in people across Canada. The wolves circled the barn, and then more insidiously, the wolves preyed from within the fold, masquerading as heroes and saviours, and then feasting on the despair and panic of besieged freedom-loving Canadians.
